These Terms of Use (“Terms”) apply to your use of soothingsoundsforsleep.com (the “Site”), run by Soothing Sounds for Sleep (“we,” “us” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Using the Site
You may use the Site and listen to our sounds for your own personal, non-commercial use, such as sleeping, studying, relaxing or focusing. You agree not to:
- Download, copy, rip, re-upload, sell or redistribute our audio or video, or use it in your own videos, streams, apps or products, without our written permission
- Use the Site in a way that breaks the law or the rights of others
- Interfere with the Site’s security or operation, or try to access it with automated tools in a way that overloads it
- Post spam, harmful code, or content that is abusive, hateful, harassing or infringes someone else’s rights
YouTube
Our videos are hosted on and played through YouTube. When you watch them, you are also agreeing to be bound by the YouTube Terms of Service, and Google’s handling of your information is covered by the Google Privacy Policy.
Our content
All audio recordings, videos, artwork, text, logos and other content on the Site and our YouTube channel are owned by Soothing Sounds for Sleep or used with permission, and are protected by copyright and other laws. The Soothing Sounds for Sleep name and logo may not be used without our permission. If you would like to license a sound for a project, email us at soothingsoundsforsleep@gmail.com.
Comments
If you post a comment, you keep ownership of what you write, but you give us a free, non-exclusive, worldwide license to display it on the Site. You are responsible for your comments. We may edit, decline or remove any comment for any reason.
Health and safety
Our sounds are for relaxation and entertainment only and are not medical advice or treatment. Please read our Disclaimer before using our sounds, especially around babies or for long periods.
Links to other websites
The Site links to websites we do not control, including YouTube. We are not responsible for their content, policies or practices.
Disclaimer of warranties
The Site and all content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will always be available, uninterrupted or error-free, or that our sounds will produce any particular result.
Limitation of liability
To the fullest extent allowed by law, Soothing Sounds for Sleep will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of, or inability to use, the Site or our content. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).
Indemnity
You agree to defend and hold harmless Soothing Sounds for Sleep from claims, losses and expenses (including reasonable legal fees) arising from your misuse of the Site or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Site will be handled in the state or federal courts located in Utah, and you agree to their jurisdiction.
